PostFab Terms of Service

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and Tap edTech Private Limited, a company registered in India ("PostFab", "we", "us"), governing your use of the PostFab application, API, CLI, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you confirm you are authorized to bind it.

2. What the Service does

PostFab helps you create social-media content: you provide an idea, brief, link, or media ("seed"), and PostFab generates platform-native draft posts for you to review, edit, schedule, and publish to social accounts ("channels") you connect. PostFab also analyzes public content in your niche to suggest ideas and provide supporting evidence.

3. Your account

You are responsible for your account credentials, your pf_ API tokens, and all activity under your account. Tell us promptly at security@postfab.ai if you suspect unauthorized use. You must provide accurate account information and be at least 18 years old.

4. Acceptable use

You agree not to:

• Use the Service to create, schedule, or publish content that is unlawful, infringing, defamatory, harassing, hateful, deceptive, or that violates the terms of any connected social platform;
• Scrape, copy, or extract PostFab's own data, content, or the research/analysis of other users, or attempt to access another organization's data;
• Reverse-engineer, resell, or provide the Service to third parties except as expressly permitted, or use it to build a competing product;
• Probe, overload, or circumvent the security, rate limits, or access controls of the Service or the platforms it connects to;
• Use the Service to process personal data in violation of applicable law, or to target special-category or sensitive data about individuals.

You are responsible for ensuring your use of connected channels complies with each platform's own terms.

5. Review and approval — nothing publishes without you

PostFab never publishes a draft on your behalf without your approval. Drafts are generated for your review; you choose what to approve, edit, reject, and schedule. Once you approve and schedule a post, PostFab will attempt to publish it at the scheduled time, and will alert you loudly if a publish fails. You are responsible for what you approve and publish.

6. AI-generated content — drafts are suggestions

PostFab uses AI to generate drafts and analysis. AI output can be inaccurate, generic, or unsuitable, and may resemble other content. Drafts are suggestions, not finished work or professional advice. You are responsible for reviewing, editing, fact-checking, and ensuring you have the rights to publish any content before it goes live.

As between you and us, you own the final content you create and publish, and you are solely responsible for it. To the extent any rights in AI output vest in us, we assign them to you upon generation. You grant us the limited rights to your seeds, content, and connected-channel access needed to operate the Service for you.

7. Public-content analysis

PostFab's niche research analyzes public content from public accounts, as described in the Privacy Policy. You must not use the research features to harass, stalk, or unlawfully profile any individual, and you must not rely on outputs about a public account as verified fact.

9. Availability, changes, and beta status

The Service is provided during an early/beta phase and may change, break, or be unavailable. We may modify or discontinue features. We will make reasonable efforts to give notice of material changes.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, reliability, or results of AI-generated content or public-content analysis. We do not warrant that publishing to any third-party platform will succeed or that the Service will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, PostFab will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, goodwill, or content, arising from your use of the Service. Our total aggregate liability for any claim will not exceed the greater of [the amount you paid us in the 3 months before the claim] or [INR 10,000 / placeholder]. Nothing here excludes liability that cannot be excluded under applicable law.

12. Indemnity

You will indemnify PostFab against claims arising from your content, your use of the Service, your connected channels, or your breach of these Terms or applicable law.

13. Termination and data deletion

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or misuse. On termination or on your request, we will delete your account data and the content and connected-channel data associated with it, subject to any short backup-cycle purge and any legal retention requirement. The removal of Creator data you had collected follows the mechanisms in our Privacy Policy.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts of [CITY, India] have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your own country.

15. Changes to these Terms

We may update these Terms; material changes will be reflected in the "Last updated" date and, for significant changes, notified to you. Continued use after changes take effect constitutes acceptance.
